What will happen to our pools?
Without restrooms available for our pool areas, will they need to be closed for heath reasons?

there are restrooms by the sand bottom pool. Right before the beach bar, to the right, there is a railing leading down below the first floor. You will see the restroom sign. You must have your card key to enter the gate that leads to the restrooms.
Yes, I know about that bathroom but is that enough? Is there a county health code that ensures there are enough bathrooms for the size pool or pools? or a code determining the close proximity of the bathrooms. That bathroom is very far from the lap pool. My concern is that the lap pool would have to be closed due to insufficient bathrooms or no bathrooms close by. The last thing we want is to have children peeing (or more children peeing) in the pool or bushes because the bathroom is too inconveniently far.
the aoao board should be sacked. they are bitter wingnuts that are willing to do anything to prove a point. the place was so much better before they came in.
The bottom line is, if the attorney couldn't get all the amenities changed over to us, none of the amenities should have been changed over. It should have been an all or nothing proposition. RMC was left with a powerful negotiating or revenge position.
The current AOAO board is elected by homeowners. For the first time. The AOAO is not a bunch of wing nuts. The reason the place has changed is because Centex gave KOD our stuff for $1.00 at the end of last year. Until then it was a beautiful place. We were too naive to understand that we were not purchasing the whole property and that we were pawns in a scheme to extract as many dollars out of us until we all had no money left with someone else picking up the pieces for cents on the dollars.
"naive"? anyone who doesn't thoroughly read and review the documentation and disclosures--preferably with their attorney--before purchasing any property is foolish. through a written agreement, centex gave kod the right of first refusal to assume control once they completed the sale and the courts upheld the contract. nothing fishy about that given that they are the master developer of the property and have plenty invested there. this was clearly disclosed in the contracts we all signed as well.
so are you naive, or perhaps you really didn't do your homework?
it is a shame that early beach villa buyers came in just before the real estate market cratered. the centex sale pushed values even lower. they should be pissed--but not at jeff stone. people need to take responsibility for their own mistakes and actions. the board is pulling everyone down into their own misery. look at the place now. so sad....
I did read the documents. they read just like many others I have read. What I did not count on was the SIDE deal Centex was working with Stone. that portion was NOT disclosed. Yes there was the right to assign but is also stated that it would assign to the AOAO or third party. 99% of the time it goes to the AOAO unless there are little deals not disclosed.
JS claims he does not want BV owners money yet he refused to put that in writting multiple times.
The current board was elected by over 90% of the owners and it seems they still enjoy that support. JS has bullied many others and it appears will continue to do so. Is this truely a blog to express opinions or to attack the board?
Early owners were able to get a court order through CENTEX in their favor granting control of the pools and recreation areas. That was a major victory for all owners! Now JS is limited to the five commercial units. Over time the owners will figure ways around JS if he does not work a real deal instead of again trying to steal from them.
You forget to mention that RMC was over charging, hiring related companies, and unable to document hundreds of thousands of dollars. Were owners just to stand by and let that continue? Who is naive?
BTW we can sack the board any time you want! You can even call as special meeting to remove them......IF YOU HAVE ENOUGH OWNERS TO DO SO. If the board is so awefull why were more likeminded individuals elected to the board?
You should be using blogs like this to offer solutions not complain. Have you offered any solutions here or to the board?
As of right now, we can only use the gym if your unit is in the JS rental program.
Once the transfer of the commercial units from Centex to JS was completed, homeowners lost all access and rights to the gym, lobby, owners lounge, beach bar, etc.
I heard the gym and the lobby have very limited equipment and furnishing. It really looks poorly. It truly is a shame. I hope someday things do work out. Its a shame that Jeff Stone is just a big bully for people who don't play in his sandbox. This truly shows why we are fortunate that we have some good representation. The other comment from above that we all should read the documents better? I tried my best to read the documents. I obviously missed the part that may have been obvious to some . I certainly believe the majority had the same issue as myself and did not find the information that states that certain assets could be sold off( for $1.00), with the first right of refusal to the developer versus us? When things as important as this are somewhat hidden that is truly a mystery why a major developer like Centex did not have a disclaimer like most developers have. I really feel the person who was able to find this, was obviously much smarter than the majority to understand. And obviously feels that the majority of people that are not in favor are just have a reading challenge. I guess I have the same challenge.

The net result of the Board's actions will be that we will end up paying more for the amenities that we already had. It is pointless.
