Thoughts on the future of the "Commercial Areas" here at the Beach Villas of K...
What's going on and what are your thoughts on the whole transfer of the "commercial areas here a the The Beach Villas?

Does anyone have any updates on the June sales event and on the "Commercial Area" issue? What do we need to do to stay proactive?
Can someone shed some light on the recent activity? I hear that the July date will most likely be put off, and that the dispute between the resort developer, unit owners, and Centex has not been resolved. I am not a current owner, but am an interested party. Are the current owners particularly divided on this issue?
I'm not sure if the July sales even will be postponed, but that is a strong possibility. Currently there are 46 owners that have come together as a group to have a recharacterization of the Limited Common Elements into Common Elements. Areas that many owners believed would be part of our common areas and owned or at the very least controlled by the individual owners. Presently, the commercial units would be turned over to another party, in this case Mr. Jeff Stone and the KOD, Ko Olina Development, LLC who has the first right of refusal, for $1.00
Many owners are stating that the connection of the commercial units with the Members Lounge, Fitness Center, pools, outdoor parking, lobby, engineering office, beach bar and the employee break room areas was not clarified by Centex and their representatives. Also, that it is common practice for these types of areas to be turned over to the homeowners association when the developer is finished in the complex. The owners would thereby control the use of these areas and the future increase in fees to run these areas.
According to one owner, Centex has agreed to a recharacterization of the Limited Common Elements into Common Elements if there are at least 70 owners supporting the change, by vote. If anyone is participating in the onsite rental pool, they have also signed over their vote, by proxy, to the KOD.
So what is going on with the upcoming sales event? I have heard that a fair number of units are off limits. And I saw the letters regarding the beach bar and front desk...
Sorry for the late response. The sales event is scheduled for Sat. Sept. 19th and 20th. The beach bar is only open two hours a day, hopefully with new owners in place that will change to longer hours. The elimination of usage of the front desk for owners renting their unit(s) out on their own is B.S. I think the timing of that with the decision of the Judge was somewhat suspicious.
So with the recent judgment (denial of TRO), are they going ahead with the re-characterization? I know this is very late in the timeline, but how successful do you think the sales event will be?
